Congratulations on your victory! I am gratified that the Seventh Circuit Court of Appeals in Chicago has upheld a jury award for the loss of the value of the pleasure of life (hedonic loss) in a case. Sherrod v. Berry, 85-3151, which you originated before Judge Leighton in Federal District Court for the Northern District of Illinois.
I would like to go on record as affirming that you were solely and exclusively responsible for initiating the idea of seeking hedonic damages in wrongful death claims and for successfully arguing to the District Court that my testimony regarding this type of loss should be allowed into evidence in that case.
Judge Leighton summarized his reasons for allowing the testimony in 629 F.Supp. 159 (1985). Appeals Judge Walter Commings affirmed that decision stating that such testimony "was invaluable to the jury in enabling it to perform its function in determining the most accurate and probable" estimate of the value of Serrod's life.
The consequence of your efforts has been to raise the collective consciousness of our legal system regarding the value of humankind. I feel privileged to be a part of that effort.
